NOTICE AND TAKEDOWN PROCEDURE

In our commitment to addressing copyright infringement, we’ve established an expeditious Notice and Takedown Procedure that aligns with the United States Digital Millennium Copyright Act (DMCA). This protocol ensures swift action against alleged copyright violations, promoting transparency and efficacy. The following delineates the essential elements to be included in notices and counter notifications, fostering clarity and compliance.

Policy Overview

Upon receiving clear notices of alleged copyright infringement adhering to DMCA standards, Saffron & Sage Skin promptly responds. Users are expected to comply with applicable copyright laws. Should credible claims of infringement be lodged, we will take measures such as removing or disabling access to the contentious material and, if necessary, terminating subscribers. This is applicable irrespective of our potential liability under United States law or other jurisdictions.

Infringement Notification

If you believe your work has been subject to copyright infringement, provide our Registered Agent with the following information in writing (preferably via email):

1. Identification of the copyrighted work allegedly infringed.
2. Specific identification of the infringing material to be removed or disabled, along with information enabling its location.
3. Contact details of the complaining party, including address, telephone number, and email (if available).
4. A statement affirming a good faith belief in unauthorized material use.
5. A statement, under penalty of perjury, asserting the accuracy of the notification and the notifier’s authority.
6. A physical or electronic signature of the copyright owner or an authorized representative.

Note: Material misrepresentation of infringement may result in liability for damages, including costs and attorney fees. If uncertain, consult an attorney before filing a notification.

Counter Notification

A content provider subject to an infringement claim can submit a counter notification. To do so, provide our Registered Agent with the following in writing (preferably via email):

1. Identification of the removed material and its previous location.
2. Your name, address, and telephone number.
3. Consent to the jurisdiction of the Federal District Court.
4. Acceptance of service of process.
5. A statement, under penalty of perjury, expressing a good faith belief in material misidentification.
6. Your physical or electronic signature.

Upon receipt of a valid counter notification, Saffron & Sage Skin will furnish a copy to the original notifier and replace the removed material within 10 business days, unless notified of legal action restraining such action.

Repeat Infringers

Per Section 512(i)(1)(a) of the DMCA, Saffron & Sage Skin reserves the right to disable or terminate accounts of users identified as repeat infringers.

Accommodation of Standard Technical Measures

Saffron & Sage Skin supports standard technical measures used by copyright owners for identifying or protecting copyrighted works, provided they are deemed reasonable under the circumstances. Our policy is to accommodate and not interfere with such measures. This ensures a cooperative approach to safeguarding intellectual property rights while respecting industry-standard protective measures.
